General Terms & Conditions

 

1.      BOOKING TERMS AND CONDITIONS
In these conditions the word “Operator” means Turas Custom Ireland Ltd. trading as Crafted Ireland, a division of Custom Ireland.

“Programme” means the Tour, Itinerary or Schedule of Services organized by the Operator.

“Programme Participant” means the Tour Participant, the person who purchases or agrees to purchase the Programme or any person on whose behalf the Retailer agreed to purchase the Programme and who is listed on the Booking form or any other person to whom a Programme is transferred which the Retailer purchased.

 “The Retailer” is the person or entity who purchased the Programme on behalf of the Programme Participants. The Retailer has the sole responsibility for all travel arrangements and costs up to the arrival and immediately following the departure from Ireland of Programme Participants.

2.     THE CONTRACT
a. No contract shall arise until the Operator has received a completed Quote Form together with a deposit for the Programme, and until such time as written confirmation has been issued by the Operator acknowledging acceptance of same to the Retailer. The terms of the Contract are contained solely in the Operator’s contract and/or Quote form or the Operator’s confirmation.

b. The Operator reserves the right to accept or reject any person as a Programme Participant, except for reasons prohibited by law. The Operator reserves the right to terminate this contract if the behaviour or conduct of a Programme Participant, either prior to or during a Programme, is likely to materially endanger the safety or well-being of other persons or that of the participant. In the event of expulsion, the Programme Participant shall make such arrangements as they consider fit, at their sole cost for their accommodation and stay in Ireland pending return to their country of origin.
 

c. The health and safety of Programme Participants is of utmost importance to the Operator and its suppliers. Where safety equipment is provided and the Programme Participant declines to use same, the Operator accepts no liability for accidents or injury resulting thereafter and or the Operator reserves the right to refuse, curtail or alter admittance if the participant does not comply. Where warning of any potential risks or dangers is outlined in advance by the Operator or suppliers, and the Programme Participant agrees to participate, no liability whatsoever shall attach to the Operator.
Where a Programme Participant is refused participation or entrance to a programme element on the grounds of health or safety, the Operator bears no liability whatsoever for such refusal and no refunds will be issued for such refusal.

3.     PAYMENT TERMS

All tours require full prepayment to guarantee space.

4.     CANCELLATION CHARGES
a. Any and all cancellations must be made in writing to the Operator;

b. The following cancellation policy will apply:

From signing of the contract........................................................10% of tour cost  

From 91 days to 179 days prior  ………………………………………...25% of tour cost

From 31 days to 90 days prior ………………………………….……….60% of tour cost

Within 30 days or less prior to start of tour start date……………100% of the tour cost  

 c. Day one of Programme is the day of arrival. Cancellation charges also apply to any extra services pre and post Programme, where organised by the Operator at the direction of Retailer.

d. All Programmes are quoted on a specified number of participants.  If the number of participants rises or falls, the Operator reserves the right to adjust the cost accordingly, based on the actual number of participants.

e. If a Programme is cancelled by the Operator due to circumstances beyond the Operator’s control, an alternative Programme will be suggested. If this Programme is not accepted the Operator will refund all monies paid by Retailer. No additional liability will attach to the Operator.

f. The Operator does not accept responsibility for any additional costs/fees relating to the issuance and/or cancellation of air tickets or any alternative modes of transport.

5. POSTPONEMENT OR CHANGE OF DATES

All Programmes are quoted for a specified date of travel.  If the date of travel is changed or postponed by any or all of the Programme Participants, the Operator reserves the right to adjust the cost accordingly subject to suitable alternative travel dates submitted by the Retailer and accepted by the Operator.  Should postponements or changes to travel dates by any or all Programme Participants occur it is entirely the decision of the Operators Suppliers to transfer any or all payments made to them or contracted to them by the Operator to the alternative dates without penalty.

Any and all postponements or date changes must be made in writing to the Operator;
By post, to Custom Ireland, G5 The Steelworks, Foley Street 1, Dublin 1, Ireland with receipt of such cancellation confirmed by the Operator or by email to your contact at Custom Ireland with receipt of such cancellation confirmed by the Operator . Alternative based on new travel dates submitted and based on the actual number of participants travelling. New dates

The Operator is exempt from liability of any terrorism incidents or terrorism threat or the individual or collective perception of a terrorism threat of whatsoever nature and kind which might occur to affect or cause Participant cancellation or postponement of travel of any programme organised by the Operator.  The Operator does not provide personal insurance cover.

6.     PASSPORTS AND VISAS
A valid passport is required for all Programme Participants. All non-EU participants must consult with their appropriate consulates to determine if visas are required. Securing visas is the responsibility of the Programme Participant, irrespective of nationality.

7.     ITINERARIES INCLUDING PUB VISITS
The legal age for alcohol consumption in Ireland is 18 years or older. All Programme Participants must have a minimum age of 18 years for entrance to drinking establishments, unless accompanied by an adult during daytime hours. Proof of age will be requested at a drinking establishment as the Operator cannot accept responsibility for non admittance on account of age. Proof of age shall be based solely on the passport of the Programme Participant. The Operator does not provide any supervisory role on any Programme. The Operator accepts no responsibility for any Programme Participant who purchases, attempts to purchase or consumes alcohol while on any Programme.

Entrance to the pubs on any Irish Pub Tour itinerary is subject to opening times of the individual pubs. Some pubs only open in the late afternoon or evening and the Operator cannot be held responsible if access is not available due to restricted pub opening hours.

8.     DISABLED PROGRAMME PARTICIPANTS
Disabled Programme Participants must notify the Operator if they require special assistance at the time of booking. The Operator will make reasonable efforts to accommodate the needs of disabled Programme Participants, but is not responsible for denial of services by carriers, hotels, pubs, restaurants or other independent suppliers. Motor coaches are not provided with wheelchair ramps. The Operator cannot provide assistance for walking, getting on and off any transport vehicles, dining or other personal needs. Programme Participants who need such assistance must be accompanied by a qualified companion.

9.       PRICES
Prices are quoted in Euro. All non Euro payments are subject to currency fluctuations.  The Operator has included all taxes, fees and charges that the Operator has control over. Credit card and Bank Transfer payments may be subject to extra bank charges by the Retailers bank or Credit Card provider and these are solely the Retailers responsibility.

All quotes are inclusive of V.A.T at current rates. All quotes are subject to change in line with any V.A.T. rate changes by the Office of the Revenue Commissioners in Ireland or HM Revenue and Customs in the UK or any V.A.T. rate change in any other country where a programme or any part of a programme takes place.

10.    ACCOMMODATION
Accommodation is provided as either twin or double bedded rooms. The Operator will request and confirm the room preference required on booking. The Operator will not be responsible in the event on check-in that the accommodation requested and confirmed by the Operator in respect of double and/or twin bedded rooms in not available.

Bed size is sold as what is standard in Europe. Normal hotel check-in times range from 2 pm – 4 pm. Normal check out of hotel rooms is between 11 am and 12 noon.

Prices are per person based on two persons sharing a room unless stated by the Operator. If a room is required for single occupancy, a supplemental fee required by the supplier may apply to the accommodation.

 

11. SMOKING POLICY
Smoking is prohibited by law in the workplace in Ireland. This includes prohibition in bars and restaurants, hotels, transport and public places. Venues may provide access to smoking areas but this cannot be guaranteed. While some hotels may provide smoking rooms, these must be requested on booking and cannot be guaranteed.

12.  BAGGAGE
All baggage is carried at owners’ risk. This applies to all sporting equipment. The Operator does not accept responsibility for non compliance with airline baggage allowance.

13.  VISITS, ENTERTAINMENT AND OTHER PROGRAMME ELEMENTS
The Operator reserves the right to substitute visits, entertainment and other features where establishments are closed or cannot be visited for reasons beyond the Operator’s control.

If the Programme Participant, at their own discretion, and without notice chooses not to partake or avail of a pre-booked programme element the Operator is not obliged to refund monies relating to same.

14.  PORTERAGE
Porterage (baggage handling) is not included in the cost of any Programme itinerary.
Where porters are requested by the Retailer and a porterage fee subsequently applies, the Programme Participant or the Retailer shall pay the excess cost.

15.  TRAVEL DOCUMENTS
All Programme itineraries are land based and exclude all air travel unless specified by the Operator.

16.  GOLF
Tour Participants may be required to produce evidence of golf handicap and must bring such evidence with them. The Operator accepts no responsibility for non admittance to courses due to failure to produce same.

No refund of green fees is provided during any golf tour. Where there is a course closure ordered by the golf club management due to weather conditions or other circumstances, subject to agreement with the Programme Participants, an alternative golf course of equal standard may be substituted and any green fee refunds will be credited after the Tour date.

All Programme Participants who are scheduled to play golf must wear proper golf attire and are subject to the rules and regulations of each specific golf course. The Operator accepts no responsibility for the behavior of Programme Participants resulting in ejection from the golf course for breach of rules or conduct or for non admittance due to breach of proper attire regulations. No refunds will be given for such breaches.

Golf clubs are the sole responsibility of the owner and the Operator accepts no responsibility for loss of or damage to same while participating in a Programme organized by the Operator.

17.   PHOTOGRAPHS
Photography in Programme itineraries and other documentation is used for illustration purposes only, and may not necessarily relate to places visited during a Programme.

18.  THE FOLLOWING ARE NOT INCLUDED IN ANY PROGRAMME UNLESS SPECIFIED:

Gratuities to guide and/or driver
Gratuities in restaurants
All Beverages
Meals
Porterag
Laundry
Telephone calls
Golf caddie hire
Golf carts and equipment hire
All other items of a personal nature
PersonalTravel and Health Insurance
Medical expenses
Any expenses incurred following departure                                                                                                                                 

19.  RESPONSIBILITY - PLEASE READ
a. The Operator is responsible to the Retailer for providing the Programme services, excluding air travel unless where specified.  
The carriers, hotels and other suppliers of goods and services are independent operators and are not principals, agents, employers, masters, servants, representatives, partners or joint venturers of the Operators or its affiliates. The Operator is not liable for the acts, errors, omissions, representation, warranties, breaches or negligence of those independent contractors and is not liable for any personal injuries, death, property damage or other damages or expenses resulting thereof.

b. Any alterations to a Programme itinerary required due to circumstances beyond the Operator’s control is not grounds for cancellation of the Programme by the Retailer unless such alterations materially affect the itinerary, experience, or sensibilities of the Programme Participants.  This shall not operate as a waiver or entitle the Retailer to a refund.

c. If the specific elements included in the Programme itinerary cannot be supplied for reasons beyond the control of the Operator, the Operator will arrange for provision of comparable where and when possible. No liability shall attach to the Operator due to such alteration in such circumstances.

d. Any resulting additional expenses from alterations to the Programme that are mutually agreed upon with the Retailer will be payable by the Retailer and any resulting saving will be refunded by the Operator to the Retailer.

e. All certificates and other travel documents for Programme services issued by The Operator are subject to the terms and conditions specified by the supplier thereof and to the laws of the countries in which the services are rendered.

f. In the event of cancellation due to an act of nature directly impacting the Programme prior to the scheduled Programme commencement date, the Operator will honour all deposits paid where possible and will offer the next available date or will make a full refund of all monies paid by the Retailer.

g. The Operator accepts no responsibility for losses or expenses due to delay or changes in Program Participants’ schedules, flight cancellations or misconnections due to mechanical problems, sickness, quarantine, weather, acts of nature, strikes, government actions, war, terrorism or other circumstances beyond its control. Programme Participants must bear all such losses or expenses.

20. INSURANCE
The Operator strongly suggests that each Programme Participant should be covered by personal insurance when taking part in any of The Operator’s programmes. The Operator is exempt from liability for any accidents of whatsoever nature and kind which might occur to any Programme Participant from whatever or wheresoever occurring.

The Operator accepts no responsibility for losses or expenses due to delay or changes in schedules, flight cancellations or misconnections due to mechanical problems, sickness, quarantine, weather, acts of nature, strikes, government actions, war, terrorism or other circumstances beyond its control.

The Operator is exempt from liability of any terrorism incidents or terrorism threat or the individual or collective perception of a terrorism threat of whatsoever nature and kind which might occur to affect or cause Participant cancellation or postponement of travel of any Programme organised by the Operator.  The Operator does not provide personal insurance cover.

Programme Participants must bear all such losses or expenses except as otherwise stated herein. To guard against unforeseen circumstances, we suggest that Programme Participants travel with a comprehensive travel insurance policy which should be purchased before travelling on any programmes where organised by the Operator. The Operator does not provide personal or travel insurance cover.

21.  JURISDICTION
The contract shall be governed by the laws, common and statute of Ireland and the Courts of Ireland shall have sole jurisdiction in respect of any issue arising out of the contract. In the event of a dispute between the Operator and the Retailer as to the terms and conditions of this agreement or anything related thereto, the dispute will be submitted to arbitration.
